Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website gausamman.org and all associated digital platforms, applications, and services (collectively, the "Platform") operated by Gau Samman Aahvaan Abhiyaan ("Gau Samman", "we", "us", or "our").

Please read these Terms carefully before using the Platform. By accessing or using the Platform in any manner — including browsing, signing the petition, registering, volunteering, or sharing content — you agree to be legally bound by these Terms. If you do not agree to these Terms in their entirety, you must immediately cease use of the Platform.

These Terms should be read alongside our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

1. About Gau Samman

Gau Samman Aahvaan Abhiyaan is a national civil movement in India dedicated to the preservation, protection, and promotion of indigenous Indian cow breeds, the promotion of A2 milk and Panchagavya-based agriculture, and the advocacy for a Central legislative ban on indigenous cow slaughter. The movement operates on the following foundational principles, which are integral to any use of this Platform:

  • The campaign operates solely under the divine presence of God, Gau Mata, and Nandi Baba — not under any institutional or organisational banner.
  • There is no single leader. All participating saints, devotees, and workers participate as equals.
  • The campaign is strictly non-violent and non-partisan. It is not opposed to any political party, government, or State.
  • No donations are solicited or accepted through this Platform. Any entity soliciting donations in the name of Gau Samman should be reported to +91 82397 11008.
  • The campaign's sole objective is that Gau Mata receives service, protection, and honour.

2. Eligibility

By using the Platform, you represent and warrant that:

  • You are at least eighteen (18) years of age, or if under eighteen, you are using the Platform under the supervision of a parent or legal guardian who has agreed to these Terms on your behalf.
  • You have the legal capacity to enter into a binding agreement.
  • Your use of the Platform does not violate any applicable law or regulation.
  • All information you provide is accurate, current, and complete.

3. Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for the following lawful purposes:

  • Reading, viewing, and downloading informational content for personal, non-commercial use.
  • Signing the petition to advocate for the legal protection of indigenous cows.
  • Registering as a supporter or volunteer.
  • Registering for or attending events organised by or affiliated with the movement.
  • Contacting us with queries, feedback, or media enquiries.
  • Sharing Platform content on social media or via messaging applications, provided attribution to Gau Samman is maintained and content is not altered.

4. Prohibited Conduct

You must not use the Platform in any manner that:

  • Violates any applicable law, regulation, or judicial order, including the Information Technology Act, 2000, the Indian Penal Code, or any applicable State law.
  • Is fraudulent, deceptive, misleading, or defamatory, including submitting false petition signatures, impersonating another person, or misrepresenting your identity or affiliation.
  • Solicits money, donations, or financial contributions of any kind in the name of Gau Samman or the campaign, whether via this Platform or any other medium.
  • Incites or advocates violence, property damage, communal discord, hatred, or discrimination against any person, community, religion, or group.
  • Disparages, defames, or misrepresents Gau Samman, its mission, its affiliated saints, or any individual associated with the movement.
  • Infringes any intellectual property rights, including copyright, trademarks, or trade secrets of Gau Samman or any third party.
  • Introduces or transmits malware, viruses, spyware, Trojan horses, or any other harmful code.
  • Circumvents, disables, or interferes with any security or access control feature of the Platform.
  • Scrapes, crawls, or systematically extracts data from the Platform by automated means without our prior written consent.
  • Uses the Platform or any data obtained from it for commercial purposes, advertising, or spam.
  • Harvests or collects personal information of other users of the Platform.
  • Attempts to gain unauthorised access to any part of the Platform, its servers, or any database connected to it.

Breach of this section may result in immediate termination of your access to the Platform, legal action, and reporting to law enforcement authorities.

5. Petition and Registration

5.1 Accuracy of Information

When signing the petition or registering on the Platform, you agree to provide accurate, truthful, and current information about yourself. Submitting false, duplicate, or fabricated petition signatures constitutes fraud and may expose you to civil and criminal liability under applicable law.

5.2 Civic Nature of Petition

The petition is a non-binding civic instrument. Signing the petition does not create any legal obligation on any government body, legislature, or official. Gau Samman makes no representation that signing the petition will result in any particular legislative or governmental outcome.

5.3 Communications Consent

By signing the petition or registering, and by explicitly opting in, you consent to receive campaign updates, policy alerts, event invitations, and movement communications from Gau Samman via email, WhatsApp, and/or SMS. You may withdraw this consent at any time. See our Privacy Policy for details.

6. Intellectual Property

6.1 Our Content

All content on the Platform, including but not limited to text, graphics, photographs, illustrations, logos, videos, audio, data, and software (collectively, "Content"), is owned by or licensed to Gau Samman and is protected by applicable intellectual property laws including the Copyright Act, 1957 (India). Unauthorised reproduction, distribution, modification, public display, or creation of derivative works from the Content is strictly prohibited without our prior written consent.

6.2 Limited Licence to Share

We grant you a limited, non-exclusive, non-transferable licence to share unmodified Platform Content for non-commercial, civic, and advocacy purposes, provided that you: (a) attribute the content to Gau Samman Aahvaan Abhiyaan; (b) do not alter, distort, or misrepresent the content; and (c) do not use the content in a context that implies endorsement of any political party, commercial product, or personal agenda.

6.3 User Submissions

If you submit any content to the Platform (such as a personal message in your petition signature), you grant Gau Samman a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, publish, and display such submission for campaign and advocacy purposes. You represent that you have the right to grant this licence and that your submission does not infringe any third-party rights.

7. Disclaimers

7.1 Platform Provided "As Is"

The Platform and all Content are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted availability. We do not warrant that the Platform will be error-free, virus-free, or free from other harmful components.

7.2 Informational Content

Content on the Platform relating to A2 milk, Panchagavya, indigenous breed conservation, and related subjects is provided for general informational and advocacy purposes only. It does not constitute medical, dietary, veterinary, legal, or agricultural advice. You should seek qualified professional advice before making any health, agricultural, or legal decisions.

7.3 Third-Party Content

We may link to or display content from third-party websites and sources, including YouTube videos, news articles, and research publications. We do not endorse, control, or assume responsibility for the accuracy, legality, or appropriateness of third-party content.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Gau Samman Aahvaan Abhiyaan, its coordinators, affiliates, volunteers, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Platform, including loss of data, loss of profits, or loss of goodwill, even if we have been advised of the possibility of such damages.

In no event shall our total aggregate liability to you for any claims arising from or related to the Platform exceed INR 1,000 (Indian Rupees One Thousand Only).

9. Indemnification

You agree to indemnify, defend, and hold harmless Gau Samman Aahvaan Abhiyaan and its coordinators, affiliates, volunteers, agents, and representatives from and against any claims, liabilities, damages, losses, penalties, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use or misuse of the Platform; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) your infringement of any third-party rights; or (e) any content you submit to the Platform.

10. Termination

We reserve the right, in our sole discretion, to suspend or permanently terminate your access to the Platform at any time, without notice, for conduct that we believe violates these Terms, applicable law, or is harmful to the Platform, other users, or the mission of the campaign.

Upon termination, all licences granted to you under these Terms shall immediately cease. Sections 4, 6, 7, 8, 9, 11, and 12 shall survive termination.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Platform, the parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Rajasthan, India. The language of arbitration shall be English or Hindi. The arbitral award shall be final and binding.

Nothing in this clause shall prevent us from seeking interim or injunctive relief from a court of competent jurisdiction where necessary to protect our intellectual property or prevent irreparable harm.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the Effective Date and, where appropriate, provide notice via the Platform or email. Your continued use of the Platform after the updated Terms take effect constitutes your acceptance. If you do not agree to the revised Terms, you must cease using the Platform.

13. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Gau Samman with respect to the Platform.
  • Severability: If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.
  • No Agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Gau Samman.
  • Language: These Terms are drafted in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
